Solicitors Glasgow

We can advise individuals who are experiencing the trauma and complexity of divorce, financial provision, separation or family breakdown. It is essential in Family Law matters that you instruct a solicitor who is familiar with all aspects of Family Law and Divorce in Scotland.

Divorce Law in Scotland

In Scots Law, there is only one ground of divorce: irretrievable breakdown of marriage. There can be various reasons for this. The most common is separation, either for one year with the consent of your spouse, or two years without consent. Unreasonable behaviour and adultery are the other reasons for irretrievable breakdown.

Where there are no children and no financial claims by either party, then a simplified divorce procedure can be followed. Where children are involved, or if there are financial claims on either side, then divorce cannot be granted without resolution of these issues. Your Complete Clarity solicitor can discuss these matters in more detail.

Separation Agreement

A Separation Agreement is a legally binding contract between spouses who decide to live apart but remain legally married. It outlines the terms of their separation, including property division, child custody, and financial responsibilities

Divorce

Divorce is the legal process of dissolving a marriage, ending the marital relationship and returning both parties to single status. It involves legal proceedings to address issues like property division, spousal support, and child custody

Financial Separation

Financial Separation refers to the process of dividing financial assets and liabilities between spouses who are separating or divorcing. This includes handling debts, property, and any shared financial responsibilities

Adoption

Adoption is the legal process by which an adult becomes the guardian of a child, assuming all parental rights and responsibilities. It creates a permanent parent-child relationship between the adoptee and the adoptive parents

Cohabitation

Cohabitation is the state of living together and having a sexual relationship without being married. It often involves sharing living expenses and responsibilities, and can raise legal issues if the relationship ends

Interdicts

Interdicts are authoritative prohibitions issued by a court or other competent body. They can prevent a person from performing certain actions or accessing certain places, often used in legal contexts to enforce restrictions
