An introduction to the plans you offer and the differences between them

Commercial – Sale & Purchase

As above if straightforward. If using PSG style Offer to Sell (whether selling or buying), and there’s a tenant and/ or lease considerations, extra reports to be obtained e.g. asbestos, EICR, Environmental etc., or any other extra considerations over and above the simple buying/ selling, then a minimum fee will be applied of £1,500 + VAT up to a purchase/ sale price of £250k, thereafter, price to increase by £500 (plus VAT) per £50k increments as per the table above up to £400k where after discretion applies.

This fee structure applies to sales and purchases. However, consideration can be given to clients’ and their circumstances. We need to weigh up what it might take to secure the client and their business against selling ourselves short, if in doubt, and only if price is a sticking point, speak to Nat. remember, we can justify our fees based on the amount of work we will do, the quality of work and service delivery, when compared to Estate Agents and their fees, and also in terms of the risk to the firm as well. The higher the price, the greater the risk.

In addition to the above, we will have reciprocal fee referral arrangements with some estate agents. If we receive a referral from an estate agent, clarify if it is on the basis of a referral fee. If so, ensure the fee is agreed with Scott, and it must be disclosed to clients in our Terms of Engagement or we are in breach of Law Society rules regarding fee sharing. Where a referral fee is agreed, this will be added on to our usual fee as per the structure above e.g. £700 + VAT will become £900 + VAT where the referral fee is £200.

Note: NDA to confirm position re VAT.

Any and all outlays are in addition to the above fees, we do not absorb these in our fee. Similarly, any tax, registration costs, etc. are in addition.

Commercial Lease (and associated work e.g. assignation/ variation)

Commercial Lease fee: £2,500 + VAT

(This should be our minimum fee for leases (and others) based on the standard PSG style and used where clients are looking to agree a fixed fee, but only in circumstances in which we are sure of what is required to be done. Where possible, we should fee on a ‘time in line’ basis.

This will not be appropriate or required in all cases, and so discretion can again be applied depending on the circumstances of the transaction – if in doubt, ask for Scott Stevenson).
